Spring Valley is an unincorporated town, so Clark County, not the City of Las Vegas, governs casitas there under Title 30 of the county code. As of October 2026, the county's changes effective March 5, 2026 removed various lot-size limits for accessory living quarters, with a special use permit still required on lots under 4,000 sq ft.
Who makes the decisions in Spring Valley?
The Clark County Commission created Spring Valley as an unincorporated town in May 1981 at residents' request. It has a town advisory board, but zoning and permits come from the county.
What kinds of lots does Spring Valley have?
A mix. The northern part includes rural-estate zoning with larger parcels, which can leave room for a detached casita. Much of the rest is subdivisions with standard lots and, often, HOAs.
What does AB 396 add?
- Clark County's ordinance cannot ban a separate kitchen in the unit.
- It cannot set stricter side or rear setbacks than the house has.
- It cannot bar renting the unit long term, but it may bar transient lodging use.
What about short-term rentals?
Nightly rentals in unincorporated Clark County fall under the county's separate short-term rental licensing program. Read Can I rent out a casita in Las Vegas? before planning around Airbnb income.
