It depends on your parcel, not your mailing address. Many homes with a Las Vegas address, including Spring Valley and Summerlin South, sit in unincorporated Clark County and follow the county's Title 30. Homes inside city limits follow the City of Las Vegas code. Henderson and North Las Vegas each have their own.
Why does this matter for a casita?
Each government writes its own ADU ordinance within AB 396's limits and runs its own plan review. Before AB 396, the differences were large: the City of Las Vegas treated a casita with a full kitchen as a Class I accessory structure that usually needed a special use permit, while the county had separate rules for accessory living quarters.
How do I find out which one I am in?
Do not rely on the city name in your mailing address or on the name of your subdivision. The parcel's official record decides it. Send us the address and we confirm the jurisdiction during the free parcel check, before anyone reads a single zoning table.
What changed in each jurisdiction around AB 396?
| Jurisdiction | Reported status, June 2026 |
|---|---|
| Unincorporated Clark County | Code changes effective March 5, 2026 removed various lot-size limits; special use permit still needed on lots under 4,000 sq ft |
| City of Las Vegas | Ordinance introduced to remove the minimum lot size and allow a second kitchen without a special use permit |
| Henderson | Major ADU changes in 2022; minor changes in fall 2025 for AB 396 |
| North Las Vegas | Staff said the existing code already complied |
Which neighborhoods are commonly misread?
Summerlin is split: generally north of Charleston Boulevard is city, south is county. Spring Valley, Paradise and Enterprise are unincorporated towns governed by the County Commission.
