A detached casita is a separate small dwelling in your yard with its own bathroom and, under Nevada's AB 396, its own kitchen if you want one. As of October 2026, the rules that apply depend on whether your parcel is in the City of Las Vegas, Henderson, North Las Vegas or unincorporated Clark County.
What does AB 396 guarantee for a detached casita?
The law requires Clark County and the cities of Las Vegas, Henderson and North Las Vegas to have an ADU ordinance for single-family zoned property. As of October 2026, that ordinance cannot, as a condition of approval:
- prohibit separate kitchen facilities
- require side or rear setbacks stricter than those for the main house
- require more than one added parking space where existing and street parking already meet the need
- require public street improvements, except repairs to streets disturbed by the work or for health and safety
How big can a casita be?
It depends on the jurisdiction. AB 396 leaves size limits to local ordinances, and each local government was rewriting its code around the July 1, 2026 deadline. We read the current code for your parcel before sizing the unit. The practical limit is often the yard itself once you account for the pool, patio cover and block walls.
What about lot size?
Requirements have loosened. Clark County's code changes, effective March 5, 2026, removed various lot-size limits for accessory living quarters, though a special use permit is still required on lots under 4,000 sq ft. The City of Las Vegas introduced an ordinance in June 2026 that would drop its minimum lot size. We confirm what was adopted for your address.
What makes desert casitas different?
- Cooling. A dedicated mini-split or ducted system sized for summer heat.
- Envelope. Insulation, glazing and roof color matter more here than in milder climates. The City of Las Vegas adopted the 2024 energy and building codes effective January 5, 2026.
- Soil. Hard caliche layers can slow trenching and footing work.
- HOA design. Stucco color, roof tile and height are often set by your association's guidelines.
What does a detached casita cost?
Published 2026 figures range from about $90,000 to $180,000 (a local real-estate guide, 400 to 700 sq ft) up to $200,000 to $450,000 (a national renovation firm, 400 to 800 sq ft). See the Las Vegas cost guide for why the spread is so wide.
